State v. J.W. (First Trial) (Broward County, Florida) Client, a licensed male massage therapist, was accused by two former female clients of committing Sexual Battery during private massage sessions. Despite the jury hearing the testimony both alleged victims in a single trial, the jury returned a verdict of Not Guilty.

State v. J.W. (Second Trial) (Broward County, Florida) At the trial of the second alleged victim of Sexual Battery, the jury in that case once again returned a verdict of Not Guilty.

 Deferred Adjudication:  

tate v. T.E. (Wood County, Texas) First Trial: State maintained at trial that vehicle involved in drive-by shooting Murder was caught on video surveillance Result: Hung Jury (Mistrial) Second Trial: State maintained that drive by shooting Murder was gang related. Result: Hung Jury (Mistrial) As a result of two hung juries, the district attorney offered a plea of Deferred Adjudication Probation.

States v. D.P. (Eastern District of Texas) Client charged in Federal Dog Fighting Conspiracy Result: Federal Indictment Dismissed (client received deferred adjudication in State Court) United.

 

Probation:  

United States v. B.L. (Southern District of Florida) Client charged in federal drug Conspiracy to Distribute Marijuana. According to the United States Sentencing Guidelines, client was facing a mandatory term of imprisonment. Result: Downward Departure from the mandatory imprisonment range based upon the clients extraordinary parental responsibilities (Client received probation).

United States v. L.A. (Eastern District of Texas) Client was charged with Intent to Manufacture Methamphetamine Result: Successfully argued for a Downward Departure from recommended prison sentence. District Court sentenced client to 46 months Probation.

United States v. D.R. (Eastern District of Texas) Client faced federal prison for purchasing firearms with knowledge they would be imported to Mexico. Result: 5 years probation

 

Other:

 State v. R.G. (Smith County) Client charged with Felony DWI (alleging vehicle was used as deadly weapon in car accident involving a minor child). Result: Client avoided a two-year minimum prison sentence and received 5 years probatoin for the reduced charge of child endangerment. 

State v. R.M. (Wood County) Client accused of committing the felony offense of injury to a child. Result: Sheriff's Office decline to present a case for prosecution.

United States v. K.F. (Southern District of Florida) Client, a police officer, charged with Extortion and Conspiracy to Distribute 50 Kilograms of Cocaine. Result: Court granted a 35-month downward departure from the sentencing guidelines.

State v. C.S. (Bowie County, Texas) Client on appeal from capital murder conviction and death sentence Result: Trial court granted 11.07 writ and vacated client's death sentence. 

State v. T.C. (Wood County, Texas) Client charged with DWI with breath over .08. ResultCase Reduced to Reckless Driving.  

State v. J.C. (Smith County, Texas) As a consequence of his prior lawyers incompetence, client was sentenced to 30-years imprisonment after entering an open guilty plea. Result: State agreed to 11.07 writ due to ineffective assistance of client's former counsel. 

State v. J.S. (Wood County) Client charged with felony offense of Deadly Conduct (discharge of a firearm). Result: Charge reduced to misdemeanor offense.

United States v. D.H. (Eastern District of Texas) Client indicted as leader of a Crack Cocaine Conspiracy. Court granted Defendant's objection to the criminal history calculation and awarded a 30-month downward departure at sentencing. 

States v. R.B. (Eastern District of Texas) Client charged with Conspiracy to Distribute Cocaine and Methamphetamine. Result: Downward Departure from the sentencing guidelines based upon an overrepresentation of client's criminal record.

State v. A.L. (Broward County, Florida) Client charged with Battery on a Police Officer and Resisting Arrest with Violence Result: Judgment of Acquittal by the Trial Court.
